QuarksUp Privacy Policy

This privacy policy informs you about how quarksUp, as data controller, processes your personal data (hereinafter "Personal Data") for commercial prospecting or communication purposes and the rights you can exercise.
This privacy policy applies to anyone who submits their data via contact forms.
This privacy policy does not apply to:
– the processing of cookies, the policy for which is available byclicking here
– the data of employees who use our solutions via their employer
– If you are an employee, your request must be addressed directly to your employer
– If you are a customer, you can send your request to our customer support (unless you have entered into a contract with a quarksUp distributor, in which case you must contact them directly).
We process your Personal Data in accordance with the regulations in force, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

1. Personal data processed

quarksUp collects and processes the following categories of Personal Data:
● Identification data: identity, email address (in particular, professional email address), phone number;
● Data related to the individual's professional life: job title, employer name.

This data is collected directly from you or has been provided to us by third parties, who guarantee that they have obtained it and transmitted it to us lawfully for processing.

2. Purposes of processing

This data is processed by quarksUp, as applicable:
– for the purpose of developing our customer and partner base. – to study and implement your suggestions.
– to provide or share information about our range of solutions and services, in particular through demonstrations, newsletters, etc.
– in all cases, for the purpose of commercial prospecting or communication about our solutions and services.

3. Legal basis

The processing of your Personal Data is based on the pursuit of our legitimate interests, namely promoting our solutions and services to our customers, prospects, and partners, or responding to your requests.

4. Recipients of data and transfers

Only persons duly authorized by quarksUp may access your data, without prejudice to its possible transmission to bodies responsible for control or inspection in accordance with applicable regulations.

All persons with access to your Personal Data are bound by a confidentiality obligation. These persons include our employees and subcontractors. Our service providers may also be required to process Personal Data that is strictly necessary for the performance of the services we entrust to them (IT hosting and maintenance, communication, electronic and postal distribution, logistics, etc.).

In certain cases and for certain processing operations, we may use subcontractors located outside the European Union. In such cases, quarksUp undertakes to verify that appropriate measures have been put in place to ensure that your Personal Data benefits from an adequate level of protection (in particular by signing the European Commission's standard contractual clauses).

5. Data retention

Personal Data is stored for a maximum period of 3 years from your last contact with quarksUp.
At the end of this period, the data is permanently deleted or anonymized so that the data subject is no longer identifiable.
If you are or become a customer or partner of quarksUp, Personal Data will be retained for the period agreed in our contractual agreements.

6. Your rights

You have the following rights:
Right to information:the right to obtain clear and accurate information about the processing of your personal data.
– Right to object:the right to object, on legitimate grounds, to the processing of this data, unless it is required by law.
– Right of access:the right to access your data
– Right to rectification:the right to request the rectification, completion, or updating of your data.
Right to portability:right to request to receive your personal data in a structured and machine-readable (computer) format and to be able to transmit it to a third party.
– Right to restriction of processing:right to request to temporarily freeze the use of some of your data.
Right to erasure:the right to request the deletion of your personal data.
– Right not to be subject to automated individual decision-making, including profiling.
– Right to decide what happens to your data after death:the right to organize what happens to your data after your death.
– Right to lodge a complaint with a supervisory authority:if you feel that your rights have not been respected, you can lodge a complaint with a supervisory authority. A list of supervisory authorities is available on the European Commission's website. For France, the competent supervisory authority is the CNIL (https://www.cnil.fr/fr).

In case of doubt, quarksUp may ask you to prove your identity by any reasonable means.
For traceability and proof of deletion of your data, we will keep your deletion request, the date of actual deletion, and the date of the response sent by quarksUp for a period of five (5) years from the actual deletion of the data.

8. Changes to the Privacy Policy

We may occasionally modify this policy, in particular to comply with any regulatory, jurisprudential, editorial, or technical developments. If necessary, we will change the "last updated" date and indicate the date on which the changes were made. When necessary, we will inform you and/or seek your consent. We advise you to consult this policy regularly to be aware of any changes or updates that may have been made.
