  • Annual limit: unless otherwise specified, an employee may not exceed 220 hours of overtime per year (legal limit). This limit may vary depending on collective agreements. 
  • Compensatory rest: above a certain threshold, the employer must offer equivalent rest to compensate for the hours worked. 

These rules require rigorous tracking of working hours. In the event of an inspection or dispute, it is up to the employer to prove that the employee's rights have been respected. As the Court of Cassation points out: "The party claiming the performance of an obligation must prove it" (Article 1353 of the Civil Code).
